Because once you are charged, there is a "cloud" about the status of the charge, and the government has a standard to require you appear in court to face those charges, so you are booked and charged, then given a chance for bail, except in some murder cases. So you are not in jail, unless you can't make the bail.

Because if you are suspected of committing a crime, an arrest is the first step in the judicial process.Except for offenses like murder, you don't have to remain in jail, you can bail out while awaiting trial.

The actual term is "presumed innocent" and the law does not say this. The phrase refers to the prosecutions burden of proof.

That's the local authorities/judicial system "padding themselves" for liability. You have to be detained for violation of the law until you go through "due process". It is every citizens right, is a bunch of BS, sure it is but unfortunately our forefather did live in a world where drug dealers kill every user one drug hit at time, nor did they have to understand raper and everything prior to. See the law is something that attorneys and judges must interpret due to the lack of detail in the Bill of Rights or your constitution so basically we have to suck it up and deal with it as unjust as it seems.

You usually get out on bail soon after arrest---unless you are considered very dangerous, or a risk to flee the area to avoid a trial.
