I was just involved in my first motor vehicle accident.The other motorist involved came out into ongoing traffic and side-swiped me wrecking my '98 Mazda 626 with her 2006 chevy Impala.I suffered a hurt leg and jammed finger from the incident,how would I go about getting compensated for my vehicle and injuries?I got a police report and her insurance information,I just need to know due process.

Well depending on the state you live in- the process can be very different.
I would suggest you first call your mothers insurance (as insurance follows the vehicle) i HOPE you dont live in the same household as her or this may cause problems but likely they will not deny the claim and will just add you to the policy.
They will explain how coverages in your state work. If the other driver is found at fault and there are no issues with their coverage (sometimes the insurance information gotten on the police report is expired or a excluded driver is driving or something) then you can go directly through her policy for your vehicle damages.
As far as your injury- some states your own insurance is primary for injuries- others the at fault parties is.
So just call your insurance and your adjuster will explain how it works in your state

How this is handled depends on the state where this occurred. Normally, when there is good coverage on the vehicle that is at fault and there is no dispute you file a claim against that driver's policy. They will give you the process information on how to handle it. In general, they will see your vehicle and pay for the damages. With regard to your injury, depending on where this happened you may be able to make a pain and suffering claim against the other person's liability insurance for bodily injury. You have to sign a release when your treatment is complete, so it is done at the end of your treatment and it does not pay your bills for you.
You should also report this to your insurance carrier. The policy requires that all losses be reported. There may be first party medical payments or PIP coverage available to you for your medical bills and/or lost wages. Essentially, report the claims to the insurance company and they will explain the coverages and how they work.

Insurance follows the car, not the driver. Take the police report, make a copy, and give it to your mom's insurance company. Also bring your medical bills for treatment for your injuries. They will handle things for you from that point.

Call the at fault insurance company and file a claim. With that claim # go to a medical facility and get yourself checked out. One should never ever call an accident if one is not at fault. Always report the claim to the at fault insurance only report it to your insurance company if other choice is presented.

The due process is that who got the ticket.From that point on you have to contact your and the other persons insurance company.The process is a game from the start her insurance will do an appraisal which is almost always lower then the true value.You also need to document and have all injuries recorded and on file,also any rental car fees time off from work etc.Injuries are separate from other damages and it is often better to get a lawyer the will do both for a win only fee.
