I am a green card holder. Had a baby who's a canadian citizen to a canadian mom (still haven't been married) and over a year she ends up staying with me for 6 months or more. Can i file for child tax credit?

My confusion is since the child is not a US citizen or a full time resident, can i still claim as a child tax credit. And the mother pays taxes in Canada.

Yes, you should also get the unearned income. If the mom isnt working or not filing taxes, been living with you and have a valid social security number for the child. You should claim head of household and you should receive all child credits due to you. You can always play around with the tax software at irs.gov or taxcut.com by answering the simple questions with or without having your w2. You also should be able to claim the mother of your child. Taking care of someone with your income only. check it out.

No. If the child is a Canadian citizen, not US, she can't be claimed.

Under the CTC rules the child must be a US citizen or resident. Must also be claimed as your dependent.
