I got pulled over with no probable cause. Two days ago I was at my moms house and the dog got out. So she asked me to see if I could try to catch him. So stupid me gets in HER car and go around the block two times. Well the police see me do this and pull me over needless to say my license is suspended. But the only ticket I get is for driving with suspended license. The officer even said he did not know what i was doing thats why he pulled me over. can he do this? The car plates come back to my mother, Not speeding, Just driving. And no I do not drive I would like my license back A.S.A.P

As others have explained, the officer did have probable cause due to you looking suspicious driving around the block. While getting a citation for driving while suspended seems harsh, the fact remains that this officer most likely could have also towed the vehicle and subjected you and your mother to all of the fees and inconvenience involved with that.

As for "the only ticket I get is for driving with suspended license", be thankful, in some states you could have been cited for driving uninsured, (no insurance covers you while your license is suspended, even if you are making payments) displaying a suspended license, (merely displaying and possession of the suspended license is a citable offense.

Take care of the suspension, and learn from this.

Just the fact they observed you circle the block is probably cause to stop you. Why do you think they bust so many burglars and car thieves??? Just be glad you got a ticket for the license. Its dumb, knowing that it was suspended, to get behind the wheel.

Common sense goes a long way when dealing with cops and yes, there are some jerks out there. If just 1% of a department is jerks, then in departments with say 3 thousand on watch, its a lot of jerks.

Don't break the law and you wont have to worry. I have been stopped a few times hunting someones house in an unfamiliar area. Didn't upset me, just made me realize that the police were doing their jobs. Protect and Serve.

The Officer was within his rights to stop and identify you. The fact that he had no "Probable Cause" in your opinion is Bunk. The Officer had probable cause based on you driving around the block in a slow deliberate manner, looking for your loose dog. You weren't doing anything illegal other than driving with a suspended license, which is what you were cited for. You already know that the Police can pull you over and cite you. You are just looking for a loophole to assist you in not having to wait some more til you can re-apply for your license.

Next time walk after your dog. Don't drive !!!

As long as you have a license it should be dismissed along with the obstructed driving charge. As far as probable cause goes that would depend on the state you live in. Some states, like Texas, allow a cop to pull you over to see if you have a drivers license. You should be able to go to the court clerk and take your drivers license up there and get that charge dismissed immediately. Look up your state Traffic laws for obstructed driving and see if having anything written on the windshield is in the codes. If not, just ask the cop when you do go to court to produce the code he wrote the ticket under. IF he can't, turn and ask the judge for a dismissal for lack of evidence and the cop being a little walking penis with ears for giving you ticket. Then, when you leave the court room, flip the bird to the cop, nothing he can about as is protected free speech.

Driving around the block slowly twice is suspicious. If the Officer had prior knowledge that your license was suspended he could have stopped you for that. In Texas it is legal to stop people just to check if they have a license. You should consider yourself lucky because in Texas Driving While License Suspended is not a citation its a trip to jail.

I don't need "probable cause" to pull you over. What is this, street lawyer 101? I need probable cause to ARREST you. It doesn't matter why you were driving around the block, when the judge said your license is suspended, he didn't include the phrase "except to drive around the block". You probably boned yourself and will have the suspension drawn out more. Oh, I am NOT required to show up to court on your ticket. My affidavit goes on the back of the copy that is submitted to the court. Don't let anyone tell you differently.

You had a probable cause of getting pulled over. If you ask me driving around the block 2 times and not going to anyones house or anything, just driving around the block is rather suspicious. So now they can pull you over because they are suspicious. Also if they ran the plates and they came back to your mother and they knew it wasn't her then they could also pull you over for that.

Driving slowly around the block a couple of times can be suspicious. Probable cause to pull someone over is just the officer's interpretation of suspicious behavior and even I would find it suspicious if I saw the same car circling my block a couple of times at low speed. (I'm assuming you were going pretty slow if you were looking for your dog.) This is totally legal.

I can picture you driving slowly around the block twice, looking all around for the dog. Now I picture a crook canvasing a neighborhood looking for houses to break in here at Christmas time. I believe both scenerios would look the same to a police officer. I would expect him to stop you to question your activities and check you out. Had you not had a suspended license you wouldn't have had any problems. You should be thankful to the officer that he is on top of crime in the area. Your mother should feel safer that there are officers actively protecting her. The next time the officer sees someone driving around your mother's house back and forth, looking all around, they could stop someone who has the intention to break in and rob her.

Well unfortunately they can and you will not beat a suspended license in court no matter what you should not be driving. You are lucky he did not tow you moms car. You were in the wrong here.
