because people are fallible, the bible says that they are resting. saul sought a woman with a familiar spirit, asked her to speak to samuel, when samuel came through, he asked saul why he disturbed his slumber.

Paul said clearly "we are of good courage, I say and prefer rather to be ABSENT FROM THE BODY AND BE AT HOME WITH THE LORD" (II Corinthians 5:8)
Read the whole passage, starting at chapter 4:16 through 5:9. See also Philippians 1:20-25 where Paul expresses the same confidence that his death would mean his coming into the immediate presence of the Lord. See also the numerous references to the saints being in heaven in the Book of Revelation; 5:11-14; 6:9-11; 7:9-17, etc)

Oh dear another that didn't read the Bible right.
The spirits that are in heaven are now called angels . Especally those that did not enter into the Physical universe that the CREATOR had made just to see it.
Just floating around no each has been appointed a job to do. weither as a guardian angel or a holy messenger. And to tend to those newly arrived souls until they are ready to understand and face the truth of Heaven.
Since we did enter this physical universe. we have free will as to weither or not we need to come back to learn or teach lessions to other souls that are still trapped here in physical forms.

No, it doesn't say that. The spirits of believers (in Jesus Christ) go into the presence of the Lord. The spirits of unbelivers go to the unrighteous compartment of hades and are in torment.
There will be two resurrections, one of the righteous ( not our own righteousness, but the righteousness of Christ imputed to us by faith) where belivers receive their glorified bodies; and the resurrection of the wicked who will appear before the Great White Throne, be judged for their sins, and thrown into the lake of fire.

Technically the bible says they are sleeping.
The whole, in heaven thing, is merely a comforting thought to those whove had loved ones pass.

The judgment could be considered unclear. The Catholic church insists that those it knows are saints, are, in fact, in Heaven, and we have reason to believe it to be the case.

I think people say this because they really don't want to realize that when you die that's the end of it until Judgement Day. They don't want to think of someone just being gone and buried.
