"Only Sons" and the draft

Contrary to popular belief, "only sons," "the last son to carry the family name," and "sole surviving sons" must register and they can be drafted. However, they may be entitled to a peacetime deferment if there is a military death in the immediate family.

Provisions regarding the survivors of veterans were written into Selective Service law after World War II. Details have varied over the years, but the basic premise remains the same; where a family member has been lost as a result of military service, the remaining family members should be protected insofar as possible.

Besides...if a draft was reinstated, not everyone drafted into the military would actually fight in a war. There are a ton of support functions and personnel behind every military person actually engaged in combat during a war.

By the way...it appears Democrats, e.g. Charlie Rangel, are leading the charge to reinstate the draft. So, if you´re an outraged liberal Democrat, don´t blame a new draft on Bush.

Under the conscience clause also called conscientious objector status in the military you don't have to fight even if you are in the military here is the definition

A clause in a law that relieves persons whose conscientious or religious scruples forbid compliance.

also we often associate the draft with the military you can be drafted in times of war to work some other federal job that doesn't directly require you to fight. You can be ordered to serve under a civilian branch of the government for the duration of the war.

I don't want to insult the intelligence of anyone but check the books you'll be surprised of the **** they can pull out of a hat. You're right it is an uphill battle but it can be done I've seen it happen twice now but you will need a civilian lawyer and to contact the media as well as your congressman.

Not exactly.

The Sole Survivor Policy describes a set of regulations in the US military that are designed to protect members of a family from the draft or combat duty if they have already lost family members in military service. This does not protect children without siblings-only those who have already had an immediate family member killed in the line of duty. It furthermore does not apply strictly to the sole surviving son, but to all surviving sons. The need for regulations first caught public attention after the Sullivan brothers were all killed when the USS Juneau (CL-52) was sunk during World War II. Since then, each branch of the military has made its own policies with regard to separating immediate family members. A notable instance of the Sole Survivor Policy is the case of the Niland Brothers, where it was believed that all but one of them was killed in action.

Claim: Being an only child (or an only son) automatically exempts you from military service.
Status: False.

In 1948, in order to safeguard the only remaining sons of families that had lost other children during World War II, the United States passed a law that exempted sole surviving sons from the draft. This exemption applied only when one or more children (sons or daughters) from the family had already died or been killed during military service. In 1964 this law was modified to extend the exemption to sons who were the only surviving male offspring of fathers who had died as a result of military service, and at the same time the exemption was altered to apply only to peacetime drafts. This law was modified again in 1971 to extend the exemption to any son (not necessarily the only surviving son) whose father or brother (or sister) had died in military service.

So, to clear up the misunderstandings, note that:

You are not exempt from military service simply because you are an only child or an only son. You are exempt only if one of your siblings or parents (mothers are now included as well) has died as a result of military service.

You do not have to be a sole remaining son to meet this requirement - the exemption applies to all remaining sons from qualified families.

This exemption is not in effect during wartime.
(Although all American men are required to register with the Selective Service upon turning 18, the U.S. does not currently have a peacetime draft, having converted to an all-volunteer military in 1973. Whether a draft held while U.S. forces were engaged in military action but war had not officially been declared - as in the current situation - would be considered a "peacetime" draft or a "wartime" draft is debatable; our query to the Selective Service received only the circular answer that since no draft is in effect at this time, we are considered to be at peace.)

No it is not true. "The last person to carry on the family name" cannot be drafted. That means even if you are the only son in your family, if you have male cousins with the same last name you could be drafted.

It's not true. You can try to avoid being drafted but it will be an uphill battle. It wouldn't hurt to be related to the president, or a congressman.
