my husband was last night, but he hadn't had a drink thankfully.
the police officer said it was because his car was parked in a side road next to a pub, the only thing is that it is the parking space outside his mates house !!!!
thank god he has the sense not to drink and drive.

I hope your husband didn't take it personally. The drink drive campaign is always high profile over christmas.
I'm a police officer and things like setting off your car alarm, fumbling with or dropping the keys a lot or maybe switching on the wipers coupled with being parkd next to a pub would alert me.
If I ignored something like that I wouldn't be doing my job.
I'm not saying your husband did any of those things and can't comment for the officer who administered the test, but rest assured, we're just trying to keep the roads safe.
The campaign will continue until New Year, but most cars carry a ESD machine so always be prepared to provide a breath sample if it's requested.
Glad to hear your husband was sensible, it's the best way.

I'm glad to see Police doing this.
In order for Police to administer a road side test they have to have at least one of three things available. A moving traffic offence, an accident or suspect alcohol. It is an offence to refuse to provide a roadside sample if any of these conditions are met. If the officer suspects alcohol then they have a power to arrest the driver for failing to provide a sample of breath and bring them to a Police station for an evidential breath test. If they do not suspect alcohol the driver can still be prosecuted for failing to provide a sample, although not be arrested.
The Police officer probably suspected alcohol as many drink drivers park their cars away from where they drink, thinking they are clever.
I wish the government would allow Police to test any motorist. We hear a lot of liberal, damp eyed crap about civil rights and that Police shouldn't do this, but I defy anyone to successfully argue this with anyone who has lost a loved to a drunk driver.
I also saw someone state that these tests biased for revenue reasons. Not so. In fact I really don't know why anyone would think this. It costs thousands of pounds to bring a drink driver to court to face a $250 fine. How can this be cost efficient? The whole criminal justice system is run at such a horrendous loss that true figures could never be published.
I'm heartened to see your husband wouldn't drink and drive. I don't take any alcohol if I'm driving as if I were have an accident then I know I was always in the best state to have been driving.
Drink drivers should be jailed for at least 2 years as losing the licence doesn't put people off.

Gee... VERY lucky thing the cop that "investigated" him was honest... most Breathalyzers are rigged for REVENUE....
Always demand a hospital blood test (your right by law).
Under what legal jurisdiction did that cop have a right to detain, question, or administer proof of sobriety tests to a person parked? Not operating a motor vehicle on a public roadway?
