The laws vary from state to state. Generally, if abuse can be proven, the child will be removed until the mother takes parenting classes and such. If the abuse is severe, or the mother has several complaints and several cases of child services involvement, the children are taken away permanently. Verbal abuse is hard to prove, too. I don't believe the child usually gets a choice in what happens. Being children, they don't always know what's in their best interest. That's why there are adults, parents, and Child Services to make sure they are taken care of and provided for.

It does depend on the state in which the family resides. Usually a social worker will come into the home and investigate the living situation and then, interview both parents and child. However, most states do not take children out of the home unless it is very severe, and nobody is trying to remedy the situation. But, if the court determines that this is an unjust home for child rearing he/ she can do whatever he wants. The power is invested into the Judge to make those decisions. But, like I said, they do not take these situations lightly, and they really do not want to take the child away from his/ her home. They just want to stop the abuse.

well if you are concerned then you should call your division of the child and families department in your state. They will then send an investigator out to see if the situation shows proof of abuse. They will then make a decision on what should happen to the family and the child. Just because a complaint is maid does not automatically cause the child to be taken from the family.
