So my parents are getting a divorce, and I'm 16 almost 17. I don't want to live with my dad anymore because he's the one that's ruining everything and I hate him (for reasons I'm not going to say) My mom said that she's going to get me out of here, but my dad might fight that she won't get custody. Since I'm 16, will I be able to choose, since I'm old enough to do it myself? Or will they think I'm a minor and I won't be able to choose?

That is a tough situation, my parents got a divorce to. Fortunately I was able to choose who I wanted to stay with. I do not have a good relationship with my dad to this day and my heart goes out to you for being in this situation. Your dad should understand that you do not want to live with him, and it will not have to be decided by the judge.

Tell your mom you want to appear before the judge and tell the judge who you want to live with after the divorce is completed.

You are old enough under the law to pick who you want to live with. Judge won't normally decide against your choice.

My Mom experienced this when she was 15 and she chose her dad because her mother was nothing more than a cheating, barfly, tramp who continually cheated on her husband.

Since you are close to being of legal age, pick the parent that will be able to provide the most for you. But above all else make sure you pick the one that will bring the most happiness to your life in this terrible situation.

I don't know for sure, but I believe at your age the judge will let you decide or at the very least give great weight to what you want. It's the little people that are difficult because they can't communicate well enough to be reliable. Just let the judge know and I don't think your dad would have a chance.

In the state of Texas if your 12 years old and both of your parents are responsible you are able to choose, and it is VERY hard in the state of Texas to take a child away from the mother,

Unless your dad can prove that your mother is unfit, the judge will ask you what you want to do. Once you are over the age of 12 you get a say.

Iam so sorry to hear that your parent divorce . iam 17yrs ,same your age ! i will help you , i see that your father has ruining everything and you hate him so not live with him because he is not right person for your family! but you not say about to mom if she is lovely, kind & good cares to you! then you may live your mom ! Remember that good dad & mom will alway love, help, good care to their child that mean it is good family! Good parent will stand together & slove problem! it will never fight Or divorce !! i will pray Jesus to give your true life with happiness

You are old enough to choose and telling the judge why you are in such pain from your father should help your chances of being with your mom.

At your age you should be given a voice in the courts.
Have your mom discuss it with her lawyer.

And in court - don't hesitate to be honest about why you do not want to be with your dad. It could make all the difference.

ok little buddy First of all depending on the circumstances your mom should be able to get you and second the judge would love to hear your opinion... just do not do somthing stupid... Life is short enough.

i believe you can choose who you want to live with since you are 16
