I am 8 months pregnant & my husband dropped me off in front of the mall which is the fire lane. He was sitting in the car for a minute while waiting for me (his hazard was on) and a police car stopped behind him. He moved forward for about 20 feet and the police car followed him. Without a warning, the officer sarcastically said “No parking on the fire lane, Merry Christmas” handed him a ticket and left. Should we appeal & is there a chance of not paying for this $100 ticket?

He was only there for sitting for a minute. The could have at least given him a warning to move.

You broke the law. Just pay the ticket, and be glad nothing bad/dangerous actually happened.

I would think you will have to pay the ticket. The parking and fire lane rules apply to everyone. I think the officer could have handled the handing of the ticket a little nicer though. Next time have hubby circle the parking lot until you are out.

The police are NOT required to give warnings. Your husbands warning was when they pulled up behind him. When that happend your hubby should have gotten the hint and driven away, not just pulled ahead and continue to sit there.

I understand what you are saying and in all right the officer does not have to give him a warning or ask him to move. The signs that say no parking is his warning. Not trying to be rude but that is pretty much what a judge would tell you. Why should the officer give him a warning when he ignored the first one. With the first one being the do not park signs. An officer with a little class should have got out and at least ask him if everything was OK and why he had his flashers on but some do not have class. You can try to fight it but I am not to sure that you would win. Good luck!!

It was nice of your husband to drop you off in the fire lane and wait. It would have been even nicer to have parked in a proper parking space and run into the store for you. I think you should pay the ticket and, as has already been said, take it as a lesson learned. Fire lanes are there for a reason.

No parking in the fire lane means no parking in the fire lane. It does not mean the yellow zone is for loading and unloading pregnant passengers only. Yeah that was nice of Hubby to not want you to walk so far but I too was pregnant once and I walked from parking space to store. Pregnancy is not considered a disability. Pay the ticket.

Your husband was given a warning: The fire lane was marked in some way, wasn't it? That was his warning not to park there.

Your husband should take this ticket as a warning to use parking spaces. If you can't walk far, he should have done shopping for you, or you should have asked your doctor if you qualified for a disabled person's parking permit so that you could have used those spaces.

You might get a sympathetic traffic judge but not likely. Your husband was really parked in a fire lane. It doesn't matter if you're pregnant, a double-amputee or any other physical challenge, and it doesn't matter how long for. Your husband parked where he shouldn't have and that's why he got a ticket. Your being pregnant doesn't mean the law doesn't apply to you.

And they don't HAVE to give him a warning! Parking in a fire zone entitles you to a TICKET, not a warning!

just in case you have forgotten-a minute is 60 seconds. At 8 months-it would have taken up to 5 minutes to get you out of the car. Assuming you like your husband-it may be another 5 minutes talking. Really-1 minute?

1) There's no way for the cops to know how long your husband was there.

2) He should have just LEFT, circled, and came back. He merely moved 20 ft forward is as if he doesn't care about the cops.

You can go for the sympathy angle by pleading your pregnancy, but your husband should have gone find a parking place to wait for you as you will be a while inside any way, as you won't be walking very fast. He should have parked and come inside to find you. Let this be a lesson.

Another possibility to plead down is "your husband didn't see the red zone, he thought it was white passenger zone". ;) Doubt it'll work, but think about it.

It's a good thing he stayed in the vehicle. Had he left if, it would have been towed and you'd be paying about $200.

In most states, this won't show up on your license, therefore not resulting in higher insurance premiums.

Pay the ticket and use it as a lesson learned that a few cops have no sympathy for pregnant women at Christmas.

I just wanted to add for everyone who is saying how capable you are of walking that I personally remember being 8 months pregnant and miserable. I do think you guys will have to pay the ticket, but I also think it is nice that your husband didn't want you to have to walk so far. Merry Christmas!
