It depends on your faith actually. Mormons commit to each other for eternity so it would be wrong for them to move on. Christians commit until death do us apart which makes it OK as the first covenant is complete. How you feel is also quite important though. My father never remarried when mum died at 44 because he just never felt right regardless of legal permission.

When I die, I'll be in Heaven where there is no Marriage. My Wife is Free. As for me, I love my Wife so much that should she precede me to Heaven, I could never be happy with another, I would never remarry.

Jesus explains this pretty clearly. We are not married in Heaven.
If one spouse has died, of course it is not cheating. If something happened to me I would want my husband to find companionship and love with somebody who would treat him well.

after a spouse dies,then the other is free to remarry,and not considered adultery,by the Bible Law. there is no marriage in Heaven. your late spouse will not be yours in Heaven

I personally would remain faithful to my wife until death, and expect her to do the same for me. I am in the minority on this, and know that. Sigh...I always seem to be in the minority.
