If you entered the US through inspection (legally), you can adjust your status even if you have overstayed your visit or are out of status. You can file the adjustment packet, which includes the alien petition, work permit and adjustment all at once. If you have any questions or need help let me know.

I think there is a two year foreign residency requirement, so you would have to file an I-612 to ask for a waiver. Be prepared for them to say no. Have a plan for going to Egypt for two years and applying at the US embassy in Cairo. I am almost positive your I-130 will be denied, because you are unlawfully present in the United States. there's a regulation that announces if an alien overstays their visa they replace into unlawful and can be deported. there is likewise yet another regulation that announces every person who marries an unlawful alien with the intention to assist them acquire a green card or citizenship would be sent to detention center and the alien would be deported. That person has a great type of unlawful crap occurring and he needs to return to his community united states and persist with the INS technique to return into america legally, commencing with a visa and green card. in case you're a usa citizen, you won't be able to legally marry and unlawful alien and that i do no longer think that any sane criminal expert would tell him that that's o.k. to proceed with the marriage. That guy is approximately to get you into some deep hardship.
