That is so wrong. The same thing happened to my husband. He hasn't seen his son in 10 years. She moved around from state to state when we would finally catch up with them. If you are in the same area see a lawyer if you don't have custody order or if she is not following said order. A father has just as much right to see his son.

If your fiance is named on the birth certificate then he has full parental rights and responsibilities. If he is not named then he can get a Parental Responsibilities court order either with the biological mother's help or with him being shown to be the father via a DNA test results. If she is a good person then she can also get him signed onto a new birth certificate for the child. (I'm not sure if this has a time deadline though) His best bet would be to go through the courts though as she's not being especially fair from what you have written, he will need a DNA result though I would imagine. People like her make me sick, everyone deserves to have both parents around, good luck!!

Biological father has same rights as biological mother, unless there has been some type of abuse. Your ex fiance is a jerk and should not keep the child away from the father. Could happen to you too, if you two have a child together, how would you feel?

My understanding is and I am basing this on Australian law so check it out first on the internet - if there is no custody settled (this means that both parents go to court and sort out the care and custody of the child - who looks after the child - what access rights does the father/maother have) now if this has not occurred then both parents have equeal rights of the child - 50% each until it is decided in a court of law. Your fiances ex has no rights what so ever to stop him seeing his child unless he has been violent or poses a threat to her or the child. I sugest that your fiance seeks legal advice.

if the father of the child is paying child support and not a sexual predator or anything like that he has visitation rights, he has or should have medical insurance, dental, vision, the works on the child as well. My question is does he want to have contact with the child. And if he does and the court has ordered it than it should be on your court papers. oh, by the way, why is it that your fiancee don't want your son having contact with his dad?

I would have thought that joint custody...visitation..etc. would have been set up during the divorce. If they were and she isn't complying, then your fiance needs to get her to comply via court order. This is just a vindictive, jealousy ploy. She'll ease up when she gets a love life going for herself again. He has every right to his son, only difference is the custodial part...meaning who the boy will live with. He need to enforce his rights,,legally. Harassing her could make things worse. Let the court do this for him.

Under scottish law,if the parents are not married then the father has no rights at all.Not sure about other countries though.You'd be best to go and see a lawyer for advice,the 1st consultation's usually free and at least you'll know where you stand.Good luck and take care.Hope it all works out for you all

What does the parenting agreement say? Some type of custodial rights should be set up up if there isn't any.

all he can do if he wants to see her is to go to court and figure all of that out there don't threaten her or anything like that because she can sew so just go to court and if he isn't on drugs or have any real issues then he should be able to see his child!
