My boss wants to use my vacation first - I have worked hard to obtain and save sick time for my surgery. Will I have to use the vacation before the sick time while on FMLA?

You should consult with HR. In my company handbook it says that we need to use one week of PTO time (or all of it if there is less than 40 hours total) before using unpaid medical leave. Our vacation and sick days are combined into PTO, so your company may be different.

No, sick time is exactly what it means, sick time. Your sick time should be used first. Your boss is just trying to screw you out of vacation time you earned so you won't be gone any additional time after you have recovered from your surgery. If you are union, file a grievance, if not contact your human resources person and straighten the SOB out. I swear, if they could employers would take your blood and first born child.

You don't have to. Don't let him force that. Use the FMLA first if you'd like.
