I have a son he is 10 now,when he turns 12 does he have a choice on who he wants to live with(mom or dad)?

Yes, he can decide where he would like to live. However, he may just want to leave because you have rules. Pray ask GOD to help you doing this time. It is hard to think of your child not being with you. However, a woman can't teach a boy how to be a man. You can raise him to be the best person that you know how. He may need his dad if he is a loving and caring father. A good role model I would encourage it. Kids do try to manipulate us. He may know that is one of your biggest fears and trying to use it on you.

This is true, by law, once a child reaches the age of 12, he has the choice of which parent he wants to live with, as long as the parent he chooses has safe living conditions.

Depends on what state you are living in. Some states the father can go to court where the child will be asked who he wants to live with. The child can make the decision. Without knowing what kind of person the father is, its hard to give you a good answer.

Yes, it is true because right now your son isn't very aware of what's going on but as he grows more aware, he can decide on where to go but he does have to feel like your house or his father's house is not an appropriate place to be.

In Georgia and Tennesee that I know of. Well, I should say that the judge will ask him, if you go back to court. Usually, the judge lets the child go where they want, but not always. Don't fret if he leaves you then. Just leave the door open for him to come back.

I think that this may vary depending on the circumstances of the custody and the state that you live in...I would call legal aid office or perhaps the court clerk on this one.

In the US, it seems that this law is dictated by which state you live in.
The request would have to be filed through the courts.
