Does the court order specify that? Most of them will.. If there is no court order than no, she really can't because noone has actual legal physical custody, they have joint custody and it would take both of them agreeing. So, yes what he's saying could be very true. Who has physical custody of the child? Is there a court order? I need more info to give you a proper answer but, I hope this helps...
