I live in old apartments and the walls and floors and ceilings are thin apparently. My downstairs neighbors are currently playing god knows what at an ungodly volume. As I type my couch is shaking...and it's 3:30 am. It's been going on for months but usually not this bad or this late at night so I haven't been that mad. But tonight it's unbearably loud and it's woken my 18 month old daughter once already. My question is this...what does a disturbance of the peace charge entail punishment-wise? If I just wait till tomorrow and talk to the landlord what would the consequences be then? Which do you suggest doing? They do this every weekend and have since the day they moved in. I'm getting insanely fed up. Please give me some advice this is the first time I've had to deal with this.

You can do a number of things in this order:

1. Go downstairs and knock on their door, and politely ask them to keep it down and explain that they woke your baby. Most decent people will keep it down.

If that fails,
2: Stomp up and down on your floor.

3. Talk to your landlord.

4. Call the police when it's going on. Not after, because they won't be able to do anything. If cops arrive, they'll most likely tell them to keep it down, and might give them a ticket for disturbing the peace.

Here is my 2 cents that I will do.
1. call the police right away because, the people broke the law, they are not suppose to have any noise after midnight.Make sure the police does not tell the disturb person who made a call.
2.Have a record of calling and write down the information about the noise and the time.
3. Talk to the landlord in the morning and ask the landlord to leave your name out.
4. While you call the police I urge you to shut your light off and pretend that you already go to bed,then instruct the cop not to contact you when he or she comes to the neighbor.
5. Do not act out of control and pretend you know nothing about then the neighbor does not come back to you.He and she may not know who is calling.
6. let the police deal with the neighbor and it is the landlord's job to warn them.
7.Do not be afraid if someone invade your right and Privacy. You pay the rent and you are entitle to your peace and do not allow someone to abuse you.
8. Contact the City Hall because, it has a Neighborhood Watch Program that can work to enforce the landlord to comply as well as the Police.

I can't say that I blame you for getting fed up, because I know I did. When my husband and I first got married, we had to live in an apartment while our house was finished being built. The people next door to us would fight, be loud, and party -- all the time. I went to the landlord, who in turn talked to them and warned them about being loud. They didn't take it too well, and it only got louder. We called the police and afterwards, the problem stopped. They got ticketed and told that if a call came in again about a disturbance, that they would be arrested. The fine is usually around $100 - $200, but it depends on the county that you live in. Contact your local law enforcement, they will be able to assist you with this problem. Good luck!

Most communities have noise laws that kick in around 10:00 PM.

Your first step will be to let them know the noise is bothersome; they may not know, since you've never complained.

Second, speak to the landlord.

Your last resort should be calling the police. You're going to have to live with these people, so want to keep a stress-free relationship.

If you call the police, they will only get a slap on the wrist, and the neighbor will know you complained. I guarantee it will make your life worse.

Legally, if you report the behavior to the landlord, they are obligated to follow up on it because it is interrupting your life. However, I would not wait until morning. I would call right now and discuss it. Explain that you wanted him/her to hear what was going on. If you do it that way, then your landlord is also getting disturbed and is going to handle it a lot faster.

I think you should call the police. The right of one person finishes when the right of another is disturbed. If you speak to your landlord tomorrow, its possible your neighbor will be warned to be more quiet. You can also speak to your neighbor tomorrow in a friendly way. If it doesnt work, call the police. ~I agree with catwoman, definitely go downstairs and tell them how it is disturbing you and your baby and ask them to keep it down.
If that doesn't work, proceed with the landlord and police. Usually after 3 reports to the landlord, they can evict them.~

I would approach the landlord first. It is touchy to approach neighbors at times. Some jerks respond by putting nails in your tires. You might try by putting a radio with soothing music on it with your child. You shouldn't have to live with this.

I will definitely call the police and also talk to my landlord...The landlord might give them a warning if the warning didn't work..They might tell them to move out..
