three men go to rob a bank. Two guys go in to take the money and one stays to drive the get way car. One of the other guys shoots the security guard and kills him. Are all three of them charged with murder. Even thou only one person shot him. And they had no intent on killing the security guard? If possible state what that person or all of them would be charged with

They can all be charged with capitol murder. A death occurred during the commission of a felony....who pulled the trigger doesn't matter.

It would all depend on which state laws apply. In Washington State all three would be charged with Murder. That is the statute. Is there any reason to it? Yeah, it's the way the legislature made it.

The man that shot the guard will be charged will Murder and the two that did not fire any shots will for sure get aggravated robbery as well as accessories to the crime. They would also be able to tack more charges on depending on the case (we would of cource need to know more details!)

They will all be charged with first degree murder, plus armed robbery.
A murder committed during the commission of a felony (like armed robbery) is first degree murder. Even if only one person did the murder.

The triggerman would be charged with capital murder (murder commited during a felony)..the other two with aggravated robbery.

If there was no intent to kill, then why the guns ? In my state all 3 would be charged.........The trigger man would receive more time, but they all would do hard time........in my state........
