Car bought in February 2006 for 40K and sold in November 2006 for 38K. ~3.3K tax was paid when purchased.

If you're trying to ask if the state will give you the sales tax back, the answer is no. Why should they?

You bought the car, you paid the tax, they keep it.

CA will not return the sales tax on the purchase of the car. Also, since you sold the car 6 months later, you or the purchaser owe CA sales tax on $38K. Tax is due because these are 2 separate transactions.

I suppose you are asking if the state will return the tax you paid. If so, the answer is no.
