Definition of Rape

Rape: Forced sexual intercourse; sexual assault; sexual intercourse between an adult and a minor. Rape may be heterosexual (involving members of opposite sexes) or homosexual (involving members of the same sex). Rape involves insertion of an erect penis or an inanimate object into the female vagina or the male anus. Legal definitions of rape may also include forced oral sex and other sexual acts.

Heterosexual rape usually refers to an assault in which a male forces himself upon a female, and homosexual rape usually refers to an assault in which a male forces himself upon another male. However, both terms (heterosexual and homosexual rape) have been used to refer to an assault in which a female forces herself upon a male or a female.

Sexual intercourse between an adult and a minor is known legally as statutory rape. The adult can be found guilty of statutory rape even if the minor was a willing partner.

Gang rape is a sexual assault in which several persons force themselves upon a victim.

Date rape is a sexual assault in which the victim is psychologically pressured, drugged or sedated before the rape. Date rape is so-named because it often involves a dating couple. The male may spike a female's alcoholic beverage, making her unable to resist his advances or even unable to remember the rape. Would-be date rapists have used sleeping pills to sedate their intended victims. In addition to adding sleep-inducing medications to alcohol, date rapists also have combined them with marijuana, cocaine and other drugs.

Rape can also occur in a marriage. Typically, the husband forces himself on his wife at a time when she is unwilling to have sexual intercourse.

Victims of rape suffer physical and mental trauma. Physical trauma may include cuts, bruises and abrasions in the pelvic area as well as elsewhere on the body. Mental trauma may include overwhelming feelings of humiliation, embarrassment and defilement. Rape victims should seek treatment at a hospital. There, doctors and nurses can treat the injuries, administer antibiotics to prevent sexually- transmitted diseases, and provide counseling or any other additional therapy (mental or physical) that the patient requires. The hospital team's evaluation and report will help document the condition of the patient for legal purposes.

RAPE - The carnal knowledge of a woman by a man (or vice versa) forcibly and unlawfully against her will. In order to ascertain precisely the nature of this offence, this definition will be analysed.

Much difficulty has arisen in defining the meaning of carnal knowledge, and different opinions have been entertained some judges having supposed that penetration alone is sufficient, while other's deemed emission as an essential ingredient in the crime. But in modern times the better opinion seems to be that both penetration and emission are necessary. It is, however, to be remarked, that very slight evidence may be sufficient to induce a jury to believe there was emission. In Scotland, emission is not requisite.

By the term man in this definition is meant a male of the human species, of the age of fourteen years and upwards; for an infant, under fourteen years, is supposed by law incapable of committing this offence. But not only can an infant uncler fourteen years, if of sufficient mischievous discretion, but even a woman may be guilty as principals in the second degree. And the hushand of a woman may be a principal in the second degree of a rape committed upon his wife, as where he held her while his servant committed the rape.

The knowledge of the woman's person must be forcibly and against her will; and if her consent has not been voluntarily and freely given, (when she has the power to consent,) the offence will be complete, nor will any subsequent acquiescence on her part do away the guilt of the ravisher. A consent obtained from a woman by actual violence, by duress or threats of murder, or by the administration of stupefying drugs, is not such a consent as will shield the offender, nor turn his crime into adultery or fornication.

The matrimonial consent of the wife cannot be retracted, and, therefore, her hushand cannot be guilty of a rape on her as his act is not unlawful. But, as already observed, he may be guilty as principal in the second degree.

As a child under ten years of age is incapable in law to give her consent, it follows, that the offence may be committed on such a child whether she consent or not.

The legal definiton is the forceful insertion of the male penis into the female vagina without consent. There can also be rape by a foreign object, whether it is a hand or other instrument. If the penis is removed then reinserted it can be multiple counts of rape.

RAPE is defined as any kinf of sexual conduct towards either a minor under the age of 18/ and or and kind of physical contact towards anyone that does not want to recieve this contact.

There must be penetration with anything and against that's persons will or penetration when the person is passed out etc.
