Non-alcoholic Beer still has alcohol in it , read the label. It dosen't have much but it's there. As for being an open container, I don't know, I guess it would depend on how pushy the cop wanted to be.

In 1997, the U.S. military ruled that the 12-hour required wait after drinking beer before piloting a plane would also be applied to non-alcoholic beer.

Just having an open container of anything is not enough for a DUI, they are totally separate offenses. As far as an open container charge, even non-alcoholic beer has a small amount of alcohol, so technically it is still illegal.

Could be. There is still a small amount of alcohol in NA beer.

People have kept NA beer in their car to open when they get pulled over to "fool the cop". They thing "He smells beer, but when he sees NA beer, it will throw him off". Most officers will issue a sobriety test or breathalyser to be sure. It's not a good idea to even try it.
