If he's on death row, then it was first degree murder.

In December of 1992, he was formally charged with Murder, Attempted Murder, Kidnapping with Intent to Commit Robbery, and Robbery. He was charged with two other co-defendants, who both received life sentences without the opportunity of parole. A jury convicted Gamache of the charges and sentenced him to death.
