sry will elaberate i am the mother my mum took her there and now we are trying to get her back she never told the father and now he wants to get her back to perth but we don't know the name of the procedure

it depends on who has legal custody and physical custody of the child,,,, and if its interfering with visitation rights,,,,,,, all of that should of been spelled out in court papers, if not, you would need court papers first,,,,,,,,

Unless the grandmother has sole custody she has no rights. If she does has sole custody and the papers spell out that she has to notify you and/or the father then immediately contact an attorney don't wait. If she tries to fight you for custody the courts will think you didn't care if you allow it to go one to long.

Call an attorney if you gave the grandmother permission but she has kept him away longer than you had planned. Call the police if she didnt have any permission and has not intention of coming back. If you think she will go on the run with the child immediately call the police.

The sooner you deal with this the better. If you let it go on to long it will look to the courts as if you didn't care.

No quite sure I understand, but sounds like you are the mother and your mom took the baby out of state without telling you or the baby's father?

Most states consider that kidnapping. Contact your local police department.

I'm still a bit confused. Did she have your permission? Are you seperated from the father? Who has custody? Where did they go and why? I can't help you without being fully aware of the situation.

It would depend on who has custody.This is a very hard subject to get into but I would think that they could possibly charge the grandmother with kidnapping and that would really be sad. You must always get permission.

Absolutely. This is not YOUR child, and you have NO right to take that child across the state line without the parents permission. You can't possibly be that ignorant and careless. What were you thinking?

If any person takes a child out of state without consent from the guardian it can be seen as kidnapping actually.
