Hi there,

A few people have already left you the link to the US immigration so I won't leave it.

I am going through the same thing as you, but I have already filed my K-1 Visa (Fiancee Visa). The American citizen has to file this.
You will have to have a copy of your divorce if previously married, you will have to supply court documentation that your children are allowed to come to the US with you, you will need a recent passport picture, and have A LOT of paper work to fill out.
Under a fiancee visa you need to be married within 90 days of your moving to the US.

The process is long and painful. I wish you luck!
My papers were filed back in Sept 06, other then a confirmation that the government has received my paper work I have heard nothing to date.

Again Good Luck to you. your children and your fiancee.

Ignore the mean comments regarding learning English from that prior answerer. I think you will have a hard time getting a visa before you marry your fiance, however I believe you would apply for a K1 visa..

She might want to seek for suggestion from with an excellent immigration criminal specialist at residing house. The community Catholic Social amenities the position she lives is a fine looking position to initiate, they have low fee, experienced attorneys accessible and may charge in accordance to ability to pay. even if you do make confident you're seen to be helping your toddler as failure to do this would adversely influence any visa software.
