Keep a notebook of everything that is going on...any bad behaviour that she does...describe it and put a date and time. Any video evidence that you can get via a P.I or yourself is also effective. Also make sure you have copies of any reports that have been filed against her, by yourself, DCFS, or anything along those lines. Most of all, dont just bring these out in court, leave it to your attorney, he will know how to handle this so it looks as you are not attacking her. Which can work against you. Show up on time for court, be courteous to the judge, show professionalism, make a better case for you than for her. Good luck

I hope that you want custody of your baby for all the right reasons & not b/c you are concocting some story that the mother is unfit b/c you are angry w/ her! If the mother of you baby truly is a great mom then don't take the child away b/c your relationship didn't quite work out! You are going to hurt the baby in the long run... but if you are genuinely concerned for the safety of your child check w/ social services. Remember to deal w/ this very delicately... many a time a concerned parent may do more harm than good! Good luck!

For the idiots that run the courts to take a child from the mother, You would need to be a saint and be able to turn water into wine and she would have to be a crack smoking wh*re, show up drunk and be shown as mentally ill and then you still may not receive custody.
I personally know of a woman that left her husband for a convicted child molester and the courts awarded custody to her over the father.

I have a friend going through this now. First off you need to show yourself extremely responsible and timely. Be able to prove it. You need to show that you can hold down a steady job and support yourself. Income $ is not as important as consistency. Be professional in court, and if you want to impress bring a resume to show your work experience. You have to show yourself more capable than the mother by far because the preference will always lean towards her in court. Get a good lawyer buddy

You are fighting an uphill battle. Unless she is in prison you will probably never get custody. If she is on drugs try to get the courts to make her take a drug test, but that will probably not guarantee anything. The legal system is very biased towards mothers. Sorry!

usualy the cort will send some one to live with the mom & child for atleast a month observing everything that goes on, then it's the dad's turn, once they have seen the better fit they will ask for evidence of abuse or neglat from the mom... if nothing is found then the jury decides wether to let the child stay or to give it to the other parent... it's realy complactaed
