he came up on the car from behinde went down the street turned around and came back...another one of his friends aproached him in another car he pulled up next to his friend there was a mustang half in the road half off the road my son was blocking a driveway a car approached him in the front so he had to back up to let the car pull in the driveway when he did he accidentally back into the car that was parked half on the road and half on the grass who's at fault.the officer said both was...but didn't give a tickett there was a wirness to what happen before the police got there the boi with the car in the street half n half moved his car...so the police man said they were both at fault and no tickets were issues and he just wrote a report...so who at fault my son for backing up or the boi that was parked in the road way.

i understand all the answers let me go with this.this didn't happen in broad daylight where he could see clearly...yes my son is prolly at fault to....my son had pulled passed the parked car...but he was blocking the other driveway of the car that pulled in front of him ..my son put his car in reverse and seen the other car that was behind him and thought he had enough room to let the car in front of him pull in the driveway...my son wanted to go faorward but the other car wouldnt move ...so he had no choice to back up in the dark with only he reverse lights to see by...now....the car that he hit was so far out in the road that when my son first went by him he had to move over to the other side of the road ......okay good....if you look at that point of the boy being parked in the road..he was abstructing traffic and you still think my son is at fault...all good answers but i believe there both at fault :) the other boy was sitting in his car he could have moved out of the way or moved

Ok, you have criminal liablity ( officer did not write any tickets so there are none)
Then you have civil liablility, if the civil court goes with the same beleif that the police officer did , then both are and both would just pay for thier own car repair.
But honestly I can't beleive the police officer did and said that
( ok, yes I believe you that he did it, but the police officer was totally wrong)
It does not matter if the other car was illegally parked, stoped in the road, if a car is stoped and not moving, if you hit it, you are at fault.
So at least in my state and the police department I used to work for, your son is at fault and he would have gotten a ticket in our area.

Very good question. Think of this...what if the vehicle was stalled in the roadway. Just because a vehicle is parked illegally does not excuse another driver for striking it. The officer is correct is stating that the person who parked the vehicle could be ticketed for improper parking; however, it was not moving at the time of the collision. The driver who is operating a motor vehicle has the requirement to move his or her vehicle only when it is safe to do so.

our Son is at fault. He hit a PARKED car. The report will go to the insurance company of both parties & they will fight it out. This will take time because the policemen did not do his job. He should have written a ticket for your son as the one at fault.It makes no differance how the other car was parked, He hit a car that was NOT moving. That is always your fault.

yes , your responsible. if you could'nt safely pass without hitting the car then you should have waited . it would be no differant if the car was stranded and unable to move . even if the car was parked illegaly , that is a seperate issue and does not remove you from liability. it's not much different than following some one to closely and hitting them because the car in front of them decided to slow down and make a turn at the last second. it's still your fault,,

Your son.....he should've received a ticket for
"backing without caution".
So....if a child was half on the road and half on the
street and your son hit the child.....who's fault do you think
it would be then?
Your son obviously just backed up with out checking out
his perimeter for any obstructions.

Be thankful he was inattentive and only hit a parked car, imagine if he had been inattentive and ran over a child!
As the driver he is responsible to know what is in his surroundings before he moves the vehicle. Stop tryng to sugar coat this for him- he screwed up.

apparently both. Regardless where the other car was, your son should have been completely aware of everything around him. The other car was not even moving. So, mostly your son is at fault.
