How cute! You should go toward the kitty with some sort of food, slowly approach the kitty and say hello slowly and calmingly. The calm tone in your voice will make the kitty calm as well. Once you have reached close enough for you to touch the kitty slowly grab the kitty, you can wear cotton mittens but no rubber or plastic glove because that might make the kitty run away because those things have smell, noise, and sophicate the kitty. (spelled wrong) at this point you should be holding the kitty gently, after that yu can put the kitty in a large box and now you have a new pet, make sure you don't run when you go outside because that will scare the cat away, also make sure no one is helping you because the more people getting the kitty the kitty will be scared and run away into someone elses house. I caught stray human shy kittens all the time when I was younger. I used a small cage with a door and tied a long peice of string to the door. I put tasty foods inside the cage and then held onto the end of the string a fair distance away and waited. Once the kitten got inside the cage I pull on the string quickly and it snaps the door shut. Keep tension on the string as you walk towards the cage to keep the door shut and then lock it. The kitten will be really frightened at first. Try to gain some trust while it is in the cage and when the kitty has calmed down a bit and isn't so incredibly frightened let it out and and keep a close eye on it.
Ps~This method may not seem nice and it was intended for the kittens that avoided humans altogether. All of my cats grew up extremely loving and affectionate. If the kitten sticks around use the sitting and waiting method posted above. Especially if you don't have a cage to use!

Get a big box, put breathing holes in it, get some cat food or some thing the cat will eat, then put it outside near your view in the yard. Wait. When the kitty goes in, count to 20. After that, closee the top and carefully walk up to a small room and shut the door. Open it and if the cat is to scared, leave and clos the door, but come back with food, water, and litter box. I hope you find her, god bless you on this cold night.

I would fix it a dry and small place ( box with shredded newspaper or clean rags and a hole to crawl into) and put it in a protected place.
When you see the kitty ;squat or sit very still on the ground and talk very quiet to it and set a can of cat food TUNA close to you.
Don't give up it will take time for it to trust you. Show up at the same time every day ( with the tuna ) and win her trust.
VERY important ...let the Kitty come to you and DO NOT try to pick her up at first or pet her.Let the Kitty initiate it.Good luck

As suggested by someone else, start putting out food for the cat (use tuna with plenty of the juice from the can). Once you see that it is a little more comfortable getting closer, you can set up a cat trap (You can buy these at home depot, Lowes or other types of stores.) You just set the tuna in the back of the trap. Once the cat enters to get at the tuna, the door will close. You can then pick up the trap and bring the cat in to a room that you can seclude it in. These traps are safe and offer a safe way for you to open them to allow the cat out again. Be prepared for the cat to go a little nuts once trapped.
Once you have the cat in your room, you will have the tougher job of getting him or her used to you. (Note, make sure to set the trap down on a towel or cardboard once in the house. If he/she is very scared, it may urinate)
One thing you will definitely need is plenty of patience.

I caught 2 of them in my yard. My dog raised them after that. I put out a metal cage. Tired a long string to it. Put food inside. Not the hard stuff. They are used to finding mice and stuff soft. So try a can of Fancy Feast or like that with a bowl of water not milk. When they go in cause they are very nosy. pull the string so the door closes. You got em. Mine is not 3 years old and because they were wild. They only know and love me. The good thing is no one ever hurt them so they have no fear. You can do anything with them. But no one else can. you can put a little food from where they are to the cage. I borrowed a small cage from a friend or you can buy one. Good luck.

You could also put a small cage outside with food. Trust me when the kitty gets hungry it will eat. But let me warn you kitty's have teeth and claws and will use them with force. So be very careful. If you want to make this kitty a pet it will take a lot of TLC and patience.

ive done this alot.. dont ever just grab it .. ... thats not a wonderful experience.. even if you have gloves on... what i would do is this:
mix up warm water and cat food.. (never milk).
put it where the kitten will see it easily.. but also near some where you can hide and wait for it.
dont just throw something over it and hope it works.. that just scares it and makes it harder to coporate. gently but firmly grab it around the middle and its hind legs. then hold it close to you or put it in a pet taxi untill it calms down.
then your on your own

2 suggestions...
1. Put food indoors somewhere, hopefully lure him in, close door!
2. If that doesn't work, call a local animal rescue group about getting a humane cat trap...they always work.
Chasing kittens can prove dangerous, both to you, and to the kitten, who may run out in traffic or do something silly in a panic to get away from you.

try sitting still, and keep your distance. The kitten will warm up to the fact that your just going to sit there and watch. Eventually he'll be able to walk over to you.
If you do try to chase him, make sure you DON'T corner him!
Animals attack when they feel threatened. It doesn't matter how big it is. It's still scared.
Leave the food out, he'll walk over if he's hungry enough.He probably got lost from his mother, that's why he's crying...
Use thick working gloves if you're afraid of getting bitten or scratched, and pick them up by the fur of their necks, they like the
comfort. It reminds them of their mother picking them up.
