The Physician will end up going before the Board of Medicine, and will more then likely lose his license to practice medicine for a long time. It doesn't matter if the patient is married, single, young, or old. It doesn't matter if it's consensual. It's ethically wrong for the Physician. I know, our practice went through the same thing. The doc had very consensual sex with a patient, and it was found out. He lost his license, and we all lost our jobs. ~~~

It is unethical for a doctor to have sex with his patient. The fact that she's married doesn't have any bearing on it. The state board would likely discipline him, but as far as what the actual punishment is... well that all depends on how good the doctor's lawyers are and how well he represents himself to the board. If he's very contrite and agrees to counseling and claims some sort of disability (sexual addiction, for instance), then they could easily let him off with just a reprimand and/or fine. The physician could easily get his license suspended or revoked in these types of cases, but usually if he plays it smart, he can keep practicing.

Tough question. Tough situation. I dont know what I would do. ALL I do know is that I would not want to be the one who knows all of this...errr....you.
I dont think I would say anything......maybe be bold enough to go to those involved in the affair and tell them you know, and that if it doesnt end, you will have no choice but to tell? idk...that doesnt seem right either.

If both dr. and patient consented, there is nothing you can do. It may be considered unprofessional to have sex with a patient, but if it consensual, it's not illegal (as long as the patient is not of dimminished capacity).

If it was concensual then I would think the only way it would get reported is if either the married patient's spouse found out, or the married patient got jealous or something.
That's perfect blackmail ammo. I would suggest not doing that kind of thing in the future.

He or she could lose their license. You may not have sex with your patient. In fact I believe that there is a certain period of time after you stop treating them before you could beginning to see them romantically.

If they investigate they will more than likey revoke his license to practice medicine. Whether it is consentual or not he still broke his code of ethics by sleeping with a patient.

a report will be filed, possibly an investigation will take place initiated by the board, and if found guilty the doctor could have his license removed and formally indicted in a court of law
