California Penal Code §626.10(a) makes it illegal for anyone to possess a BB gun on any school grounds (K-12, Public & Private). It is classified as a felony wobbler. This law also applies to paint ball guns and AirSoft guns.

In Georgia, a B-B gun is not a firearm. In order for it to be considered a firearm, it must be a .177 cal pellet gun that will still shoot B-B's. If the student presents the plastic gun as a real gun in a crime, then he can be charged with the code covering that crime and using a weapon. In order to provide you with a Penal Code, I would have to know what state in which you reside.
