If she owns the home and your brother has driven her out of it... at a minimum you should be charging him rent the covers the cost of mortgage payments, plus some extra for the inconvenience.
However, if he did indeed drive her out of her own home through aggressive behavior, I would have the sheriffs department or the police evict him from the premises so that your mom can return home.

If I am reading this correctly..your brother and nephew are living in your mothers house, and your mother is living with you...due to the behavior of the child....
If this is the case..there is nothing the police can do..however, your mother should get a court order to have them removed from her home...it will cause hard feelings..but, she shouldn't allow them to take advantage of her.
Your a trooper to allow this to go on....but, somebody needs to look out for your mom..and it sounds like that someone is you....Stand up for what is right for your mom....Good luck!

your mom should go back to her house and kick her son out. if over 18 you are an adult and need to live on your own, even if that means sleeping in your car. a mooch will never do anything for themselves as long as others allow them to mooch.
you should stay out of it as it should be between your mom and that son, even though family, this is her place to deal with it, not yours.
if she has to call the cops and have him removed, tough love is sometimes called for. parents job is to make an adult out of a child that fits into society well and operates and has a job. since he's mooching off her and made her leave, she never did her job up to par, so now its time to slam the foot down aka tough love.

I think I read your question correctly... If your brother is living in your house and he is over the age of 18 you can evict him based on his behavior and aggressiveness. Dont let him bully your mom, she does not deserve it, afterall she raised you to be a concerned adult.

i would make him leave and get your mom's house back immediately. if your mom doesnt have the heart to get him out, i would charge him what i would charge any one else. he needs to know what it is like to be out on his own. how old is this guy anyway? you can have him kicked out by the law. give him an eviction notice.well good luck and merry christmas.

If your older brother is such a problem, why don't you or your mother evict him? Just tell him to shape up or ship out!

Sure. But I can guarantee it will only cause more drama.
In the end ,nobody can take advantage of you without your permission.Think about that real hard. Many people never get it.

Depends. Set a time limit for him to move out. If he over stays his welcome let him know he will have to pay. Also depends on if he is working or in school or whatever
