I have had my son since three days after he was born..His biological mother has never wanted him since she found out she was pregnant. I was her roomate for about four years before he was born so when I saw how dissappointed she was I tried everything to make her happy. I supported her through the birth and when she came home she told me she did not want another child, then asked if I would take him. She has never wanted much to do with him unless she was looking for attention from people around her, and she has never paid a dime of child support. He is now two years old and very happy. I bought he and I a nice little house and we are doing well. I have never denied her seeing him either. At the moment all I have is gardianship of him, but I really want to file for adoption. Not to hurt her, but he deserves to have a stable permanet life. She has been threatning to take him back and although I don't show it, I'm scared I might loose my baby because I have no blood rights.

WOW! what a terrible situation. to answer your question, you don't have any rights to adoption without blood parental consent. There was a nationally exploited custody case in Michigan where the birth mother signed adoption papers to another couple who raised the child for 5 years. However when the blood father found out that he had a child he fought the case for parental custody and won. Somehow try to look it up on line, I don't remember the names but this happened in Ann Arbor Michigan. also call lawyer for solid legal advice.

I don't know. Sounds like, by all issues, you should be able to keep him since she did give guardianship. But I can't tell you anything. Most of the time the courts are retarded and don't look at what is best for the child--just biological factors...

first it's going to depend on what state you're in and the laws there...

most likely she'll win, unless you can prove she's unfit to care for the child. witnesses, letters, pictures....etc....

Sounds like you are a loving person who has and will take care of this child, so you'll want to surround yourself with people who will back you up completely...

u are right to be concerned.....blood mother will win

remember---everyone makes mistakes and you can never replace the blood mother

it's hard to say, but you should do it otherwise she will keep threating to take him and that is not right.
