I would say if she is working for you , your company is responsible. I would set her down and relieve her of her duties. She is employed by your company when she is going to the other location where she is doing a task. If she gets into an accident, your company is responsible for her being at the location she is at. Which means that you are going to be sued also.

You are most likely an employer at will, right? Is this misrepresentation grounds for termination, or can this employee perform another task that doesn't require her to drive in the scope of her employment? Basically she's breaking the law if she lives in a state that requires vehicles to be insured. How will your company view that? If it's a big thing you'll probably have to let her go. You have a right if she travels on business to know if she has a valid license, I would think.
Now that you know, if she has an accident, you can't claim innocence if your company is sued because she was acting as your agent. You need to get this sorted out asap. Your company is exposed. Technically you are even if she's insured and a licensed driver, but it would be harder to get to you if she had insurance, etc.

1) If she is working for you (ie: doing company business on company time) then the company has a significant exposure if she is involved in an accident. ESPECIALLY since you are now aware of it. (We are talking about YOUR job now).
Large companies are now required to have an operations manual which among other things should list job descriptions.
If you have one, does her description require a Drivers License.?
If so, she must get one or you must alter something (the job description or her employment conditions).
My advice, for what little that is worth, is that you IMMEDIATELY pull the plug on her driving (her car OR the companies car) for the companies business. Meantime an expired license is easy to fix. Deal with the insurance after that.

I work as an outside vendor, I am on the road everyday.
I have to submit proof of insurance yearly. My DMV records are subjected to random checks. One speeding ticket, is a warning....the second speeding ticket is a release from employment.
If you did not ask for proof of insurance, she did not have to disclose her lack. You would just think everyone has auto insurance.
Expired license, isn't all that 'bad', but is does show a lack of responsibility. Are you sure it wasn't revoked???
I hate to even add this one. Normally you cannot renew your registration without current proof of insurance.
Your role is to remove her from this job task......ASAP. The corp now becomes responsible for her actions, if anything occurs while she is on the clock.
I would check into having a background check with DMV search done.

you need to find someone else to do the task or tell her she has to have insurance & a drivers license...if your company insurance finds out that you are letting her do company work without them...you could be in some deep trouble if something happens while she is driving

She needs to get it all straightened out before she can drive ANYWHERE again. You should tell her that you are not responsible for any trouble she gets into if she continues to drive. She needs to find another way of transportation.
My boyfriend's license expired on his b-day, and he works at a dealership. He couldn't drive until it was all straightened out.

if she has to drive her own car, your role is nothing. but if she drives one of your cars you better have her stop. In other words the way she gets to work is her problem.
