if the ex is ok with it then brill, but if he wants to fight you in court then you may be in for a bit of a ride hun. the court will look at both your situations and they will also consider the fact that your daughter has been living with her father for however long. depending on how old your daughter is, they may ask her in court, and will consider her wishes. wish you all the luck in the world hun, xxx

the three of you should sit down and talk. decide what is best for the child and the motive. sometimes a kid will try this because they are mad or don't like the rules at the other parents. legally without any custody order you can do what you want,but it may start a long court battle. if it does come to a legal battle you can get custody without a lawyer,just research. to you people that says a mother has some "right" to the child,a child is not property.

You don't say much about how old your daughter is, why she's living with your ex (which I assume is her father), or why she wants to move back in with you.
Let's assume she's a minor and she hasn't been living with her father because there were abuse / neglect issues on your part. IF there is no formal custody agreement / court ordered custody, in most cases, as the mother, YOU would have automatic custody. However, since she has been living with her father (don't know for how long or why), if he is not willing to let her come live with you, your best bet is to get a laywer.

If there is no official custody arrangments then you and your ex and your daughter are free to do whatever you like. If she wants to live with you and he'd resisting though you'd have to take him to court to get her. Depending on her age it may be as simple as a judge saying "yes she's old enough to decide, you win" or if she's younger you may need to prove you can provide as good or better an environment.

Alot depends on how old she is and whether or not your ex is happy about her moving in with you, I can't really see any problem but might be best to seek legal advice just in case.
Also a note to Vicky....mothers dont always get custody. The courts awarded custody/residence of my husbands son to him,who is now happily living with us, also back in 1977 my dad was awarded custody of my brother and myself and he was one of the first father's to win this right in the midlands.

Legally, you both have equal rights and custody. If there is a problem that the two of you can't work out or agree on, you will need to go to court to take care of it and reach a solution.

go into a solisitors office and file for custody of the child b4 she moves out because
i moved out of my daughters dad house and he said i wasnt alowed to see my daughter he took of with her to bendigo near vic she was 13 monts old then i got to see my daughter when she was 22 months because the court order was in place it hurt like hell not seing my baby so dopnt make the same mistake if u need any more advisae just add me in yahoo saras_pooh_bear the father made lies and stuff up since then i goyt custody

For the sake of the child you have to get together and discuss the situation and include her in the discussion. She may have very valid reasons for wanting to make the move and it is important that you find out why before you do anything.

If there are no custody arrangements you should talk to your ex.
Make sure that this is not one of those deals that she will be jumping between you and your ex because she doesn't get her way. If it is just a issue of her being happier living with you.......To me that would be an automatic for her to live with you.
