If he lives with you then your ex will have to pay you child suport. To get a child to live with you is the hard part. Courts usually have the child live with the mother. To win coustody you have to prove that you can provide a better life for your child and that your ex won't be as good a parent as you. You have to prove the childs mother to be unfit. You will need proof of something that will show she isn't able to care for the child as well as you will be. Like has she been to jail or prison? Is she an alcoholic, drug addict or not mentally stable? Is her home fit for the child to live in? Are there roachs or is the home not safe because of a bad neighborhood? Has she ever hurt the child? If he lives with you, most of the time the non-domicilliary parent pays child support. If you do get co-domicilliary, with equal time, most of the time you do not pay child support. Not sure if you are the mother or father, put you have to have strong evidence that the mother is not fit for the father to get custody. The best thing you could do, would be to get your lawyer to have joint custody and co-domicilliary. That way the child spends equal time with each parent. If that works for you and your ex, make sure that you stick to the schedule and have the kids when you say you are going to have them. Kids don't understand. Also, the kids have nothing to do with the divorce, so make your relationship with your ex just that...a business partnership which raises kids. Sit down with your ex and make a list of rules that are the same at each house...it is difficult for kids to go back and forth with each house operating differently..ie: bedtimes, punishments, and other rules. Just try to make sure things stay as normal as possible for the children. And most importantly, do NOT talk bad about the other parent in front of the kids.

You need to talk to a lawyer. If the child lives with you then the other parent pays child support. If you already have an agreement that you pay child support, you have to go to the judge to get it changed.

If your child lives with you and you provide for he/she then you are not expected to pay child support. To have your child live with you, you must first est. yourself and be able to provide. Good Luck.

If he lives with you then no you don't pay because you are paying for everything he needs. Mom would actually have to pay.
