If you can proove that it is in the child's best intrest you can get full custody. It normally means the mom has lots of problems.
I don't know any judge that for just no good reason would take a child from it's mother. I wish I could tell you differently. I know many Dads that are better parents than the mom's are, but it just does not work in your favor unless your wife is a stoner or an abuser and you can proove it. Or if she puts your child in harms way.
I say hire a private detective and a great lawyer see what you can dig up on her !!If you want your child that badly I hope you win!

You would have to prove that she is an unfit mother. Unless she does not want the child or has a severe problem, try to get joint custody and decide which one will be the custodial parent.
A child joins both parents for life if they have the best interest of the child in mind.

Good luck, dude. Those court decisions are always unfairly biased in slant toward the mother. You can't get full custody short of her being a full-blown crack w h o r e. The way our screwed -up system works is that the mom gets the kids and the dad gets the invoice.

Well..if she doesn't want him then it's simple....but if she is putting up a fight....you have to have resonable cause as to why she shouldn't have joint custody and you would have to prove it in court. Abuse, drug/alcohol addiction, endangering the child or inadequate care.
If any of those things are happening then you need to take it to court. If they are not....then you shouldn't be trying to take the child away. If this is only to be mean or hurtful to the mother...then you need to rethink it. In the end...your son will be the one that is hurt.

Go to court and fight for it. If you can prove that his mom can't provide a fit environment you'll get him. If she can, but you can provide one jsut as good, you may get split custody. If she can provided one significantly better than you, she wins.

get a good attorney, there are also groups that support men gaining custody of their own children. look into it they can give you advice in the whole process and support! goodluck

that is sad. most often we don't know that we want someone until they are given the opportunity to leave our presumed custody. most often it is when we realize what is required of us that we tend not to be able to part with.
