From reading the christmas Radio Times for the next 2 weeks, it seems that Clare gets found out and receives her comeuppance.

I think that he will, from reading future episodes in the tv magazines it gives the impression that he will. But that might be what they want you to think!! Claire goes to prison though. (Yey!!)
Found this on the tv times website - which sounds pretty damning for Max.
Following Craig's slaphappy incident, Sarah tells him that Hannah is not to find out why he hit John Paul. But John Paul lets slip to Hannah that he has feelings for Sarah. Clare is probed at the police station. OB sorts through Max's things, lost in his thoughts. Sasha has her sights firmly set on Justin, despite his resistance.
Dominic and Tony are concerned as OB offers to take care of Il Gnosh to get his mind off Max. Tom's words hit home as OB takes steps to fulfil a belated Christmas wish. Louise is in great demand when Warren and Calvin both ask her out.
Does not look good for Max!!

Claire tells him that she heard screams coming from the lake at they were that of Little Tom's; so Max jumps in and freezes to death...
I read this in a couple of magazines. I really hope this isn't true though and someone pushes that spiteful b*tch into the lake instead...

this is shock news i havent watched hollyoaks for a while, it sems like they are killing off all the older characters (except Tony). i hope he doesnt die, and tom is too cute to die at such a young age.

Yes, claire tells him that tom has fallen into the lake (but hasn't) so max dives in and dies from that.
