If the helmet has not been tested to any EU/UK safety levels, then it is viewed as if you are not wering any helmet at all.

UN ECE Regulation 22.04 is not regarded to be equivalent to the British Standard because it does not contain a chin-guard test for full face helmets or a test for rotation-inducing forces caused by projections and surface friction.
Under law, If you are driving or riding on a 2-wheeled motorcycle on a road you must wear a helmet. Passengers in a sidecar don't have to wear a helmet and neither does a Sikh who is wearing a turban. Also, no helmet is needed if someone is pushing the motorcycle on foot. Alternatively, you can wear other types of helmet which could reasonably be expected to give a similar, or greater, level of protection in an accident as British Standard BS 6658:1985 or UN ECE Regulation 22.05. However, you should seek confirmation from the supplier that the helmet does offer at least a similar level of protection. Check with your insurer that your insurance is not invalidated by wearing a helmet that does not comply with a standard listed in the Regulations.
The penalty for No Crash helmet on Motorbike in Ireland is 2 points on the spot or 4 points in court. Its the same if you have a pillion passenger without a helmet.
In the UK, the traffic violation is worth around 3 points, and is classed like a safety defect in a veichal (no brakes), so is a level 3 offence with a max £1000 fine

Good question! I think the reason why is because they are only going to drive in town, but they still at least wear a helmet. When I am out on the road I see motorcycle drivers quite a bit when the weather is warm, and at times I see motorcycle drivers not wearing helmets while they are on the cycle whether they are a passenger or the driver. Sometimes, I see the driver in a T-Shirt, shorts and flip flops and/or sandals. On a rare occasion, I will see someone in all motorcycle attire such as a leather jacket, long pants, boots, etc. What worries me is if they get involved in an accident and they do not have the proper attire on.

Normally just a fine as a least you were wearing a helmet. It's £60 and three points min. if you don't wear one at all. Most helmets don't have the BSI mark anymore, just the equivalent EEC marking. You be hard pushed to find a bike helmet that didn't comply anyway.

You can be considered to be wearing no helmet at all and punished for this. You can wear just a pair of Y-Fronts so long as you have a suitable helmet on at the same time. Crazy!!
Why would you want a non kite marked helmet, there are loads of reasonable ones about?
