It is a sexual harrassment case, the only time I hear anything is WHEN I call the office. when I do call most time they have forgotten what they told me the last time they spoke with me. Would it be best for me to abtain another attorney? Thanks

Civil lawsuits (and even some criminal ones) can drag on for years. However, it doesn't sound like you have a very aggressive lawyer. I would request a meeting with him. At the meeting, I would ask to see what he has done to work on the case (has discovery been done, have depositions been taken, etc.). If he can't show you he's done anything, I'd tell him you are going to get another attorney.

Lol. I work at a law office, so I would relate. Ummm... The next time you call him, ask him what the statute of limitation is on your case (hopefully it's not two years). If your statute of limitation is not two years, then what you can do is just to push him to get it done. Call often and let him know you are concerned about your case. The key is to bug them.

You can obtain another attorney through a form called "Substitution of Attorney" and you can ask your attorney for that cuz he's going to have to sign that document anyways, if you do switch attorneys. Also if you do, ask for your file; get ALL your documents so your new attorney can know what has and has not been done.

Sexual harassment cases are ambiguous; it's usually she says, he says (depending on the case though, I don't know what happened). I don't know what the process is, but I imagine that it's things going back and forth from your attorney to the opposing counsel.

Just keep calling and ask about your update. If you're completely fed up by now, just go ahead and switch attorneys - your attorney shouldn't have a problem with it; hopefully you have your Retainer Agreement in case he tries to pull something with you.

i work with attorneys all day long with personal injury lawsuits.... i think that you should schedule a meeting with your attorney and see where it's going.. ask a lot of questions-- like if they've been able to contact the defendant and stuff like that.... if he doesn't sound like he knows what he's talking about then you should definitely let him know that you will look for another attorney- this might make him work harder on your case.. a personal injury case usually take 2-3 years, but this one is different--- you should get the best attorney for this kind of issues..

If they have not communicated with you in two years, retain another law firm to handle your case. Be sure you get a law firm that has attorneys familiar with sexual harassment cases. Not every law firm does sexual harassment matters.
