Some of them contain both cake and ice cream, like Cookie Puss from Carvel, as well as other cakes from Carvel. So yes that makes it legitimate.

it is a real cake because it has a cake on the bottom. there is a part on the bottom which is made of materials cakes are made of then, it is baked.
so an ice cream cake is a real cake.
