my friend needs some advice about custody in michigan. She's been a single parent for 10 years and was never married to the father. there was never an order for custody or anything but the father did acknowledge patenity sometime in the 10 years and was order to pay support but never has.. ok maybe once but sometimes she wont hear from him for several months at a time and one day out the blue he'll call and demand to see the child. he has been violent and abusive to mother and child who doesnt want to visit. she want to terminate his rights if any

well truth of the matter is..if he's been violent and abusive she needs to call the police WHEN it happens. Go to Radio Shack and they will sell you everything you need in order to tape phone conversations so you will have evidence of everything he says too. She needs to go to court and get an order of custody..otherwise if he wants to be a jerk he can always sue her for custody in the future..and may get it too. She also needs to go to court and document that he never pays support. otherwise she will have no proof of this either...
This is all stuff I've had to do myself.

Last I knew, she could go to the court house and just file for custody. The first parent to establish custody gets it when custody hasn't been established. She should call a lawyer and double check this, but that was the case about 2 years ago.

If this guy is abusive, she should take steps to protect her and her child... write incidents down and date it, have tapes of conversations and save emails.

If parent child relationship, for father and child, has not been established by the court, then the father has no legal rights to the child. That said, if she has not documented the abuse, by reporting to the police, if he sues for paternal rights he will more than likely get them.

Contact social services and ask for advice..they will lead her in the right direction.
