Hello All & Thanks (Upfront). I just went 2 court today & got results of a paternity test (father denied child as his own) & then I was awarded child support -once proven he was the father. I live in N.J. & am currently unemployed after being put on bed rest & then "let go" from my position- once I was not able 2 return back 2 work (due 2 the baby & complications). The place of employment only hires in the spring, so I'm patiently waiting for positions 2 open up (Because I'm trained in my field of work). My question 2 you is, will I get awarded more in child support once I start work in the spring? A friend of mine said yes, but I'm not 2 sure as 2 why?
Example. He now makes $1100. *before taxes a week & I make 0.00
When I start working I'll make about $800. - $1100. a week before taxes & he will be making the same $1100. a week.
I dont understand & honestly not even sure if it's the case, but if so - why by me working will I get more in support? Due 2 daycare expenses or what??

In the state where my divorce took place (GA), my income has absolutely nothing to do with the amount of child support I receive.

I guess if daycare costs were not factored in with the original order then it's possible you could get more. Find out what percentage your state awards for child support. For example, the range for 2 children in Ga is 23-28% and I get 25% which is right in the middle of that range. I believe the range for 1 child is like 18-22% so you might see if what your getting is close to that range and then see how it compares in the state of NJ. If you are currently getting what the state of NJ says you should be getting for the number of children this man is paying for, then you're most likely not going to get anymore because that is supposed to include everything.

Why would you get MORE support when you start having an income? That doesn't make a bit of sense to me. If you start making money when going from none than you can pay for daycare while you work. Here in Texas, they don't care what I make, only what the person paying makes.

no you will not..you could look on the state website, i have lived in 3 different states not NJ, but it is a fomula so just put in the numbers..generally there is not a difference if the numbers are both the same or below 2 grand per month..they can make him pay half of the daycare care expenses, (by a lic daycare rovider, not your family), but then you woudl have to pay the other half, so number wise you would not be getting more

Yes and no..... If you are living on your own then yes, but if you are being supported by someone else then yes. If you are living on your own how much is your rent and daycare and all of those other expences. And will you need state help. then more in need of assistance you are the more you will get in support. but If he is buying stuff for the child and showing recipts then NO. sorry that is the way it is.. My sister is going through the same situation.

He will definately not have to pay more if you make money. They only take out a percentage of what HE makes. It has nothing to do with your income. I'm dealing with child support at the moment with my husbands ex...

You won't get more child support once you go back to work. You MAY end up getting less, if the father is inclined to take you back to court to modify his child support obligation.

Child support is based on his income, since his income isn't going up or down the payments will remain the same.

Well your friend is absolutely WRONG! You don't get more money because you work. You only get more money from child support if your baby's daddy makes more money and you take him to court for more child support.

All I know is a Friend of mine makes over $100.000 a year and he has 2 kids and pays $1950 a month.

you may get less child support once your working. not more. you wont get more who ever told you that is wrong. you may get less not more now that you have an income and how can you afford the internet with nothing coming in. i find it hard to believe that you have nothing coming in you would be homeless
