Hello All & Thanks (Upfront). I just went 2 court today & got results of a paternity test (father denied child as his own) & then I was awarded child support -once proven he was the father. I live in N.J. & am currently unemployed after being put on bed rest & then "let go" from my position- once I was not able 2 return back 2 work (due 2 the baby & complications). The place of employment only hires in the spring, so I'm patiently waiting for positions 2 open up (Because I'm trained in my field of work). My question 2 you is, will I get awarded more in child support once I start work in the spring? A friend of mine said yes, but I'm not 2 sure as 2 why?
Example. He now makes $1100. *before taxes a week & I make 0.00
When I start working I'll make about $800. - $1100. a week before taxes & he will be making the same $1100. a week.
I dont understand & honestly not even sure if it's the case, but if so - why by me working will I get more in support? Due 2 daycare expenses or what??

It could go up...it could go down. There are NJ child support calculators available on the web. Here is one...http://www.alllaw.com/calculators/Childsupport/new_jersey/

NJ appears to take into account BOTH parents incomes, the cost of health insurance and the cost of daycare. When any of these variables change it can change the amount of support. Often support is a percentage of the total income of both parents. For example- a child support order for parents whose combined income is $100,000 will be MUCH higher than a child support order for parents whose combined income is $30,000.

The addition of daycare costs will probably be the biggest impact on the support order.

Use the calculator and figure out what will happen when you start working. When I plugged in $1100 for him and zero for you (with no health insurance or daycare numbers) the support was $265. When I plugged in $1100 for him and $1100 for you with no additional costs the support was still $265. When I plugged in $1100 for you and him with $300 in child care the support went up to $296. As you play with the numbers you will see what happens.

I live in NJ and receive child support. Basically what will happen....
A child support work up will have to be redone. Right now it is based on you not having any income. An increase or possible decrease may take place depending on how much you will make vs daycare vs the fathers income. Due to the fact that you will now have daycare is a good indicator that it will probably increase. I just went through a similar situation but in the opposite direction. My son stop going to daycare and started kindergarten. My x went to his lawyer and demanded a new child support work up be done. I was paying $176.00 a week in daycare. I received $166.00. So basically the child support was going directly to daycare. My x makes about $150.00 a week more than me. Now it has been reduced to $75.00 a week. Hope this helped!

You county/state should have a website that you can refer to but, when you start working your income will be considered and it very unlikely that you will get awarded more money. Chances are you will recieve less, now that you have an income. There is an standard equation here in NC that takes into account both incomes, the childs age, and from that an amount is awarded. My husband pays child support and when his ex went back to work, his amount went down because she was now making money to do her part in the raising of their child, I would verify this with your case worker or check out the states website

You could possibly get less. Contact your local Child Support Enforcement Agency(this can be done on the web) to obtain a copy of the formula they use in your state to determine child support.Ohio's is complicated so my boyfriend did mine for me.Over the years with me having various jobs it did fluctuate. Child support payments are based on his income only, you can also have him pay separately for daycare. You should check the state laws on child support to make sure what you are in titled to. Good luck!!

I don't know the answer to the question but want to warn you to research and get ready because if he starts this thing off denying the child, he will probably argue you down the path of parenthood every time he makes a payment. child care expenses should be factored in and you should be proactive to include that...good luck

The child support is based on the fathers income. Normally it amounts to 27% of his pay....unless there are extenuating circumstances. Your income has nothing to do what he is ordered to pay.

you wont get more, I believe you may get less if he takes you back to court to lower the support order once you are working. as far as daycare expenses go, they are not covered unless it is specified in the court order. try posting this on divorcenet.com

Unfortunately the amount of support paid to you is based soley on what he makes, if he starts to earn more than you can have the support payments adjust accordingly

From my experience they do not factor in the mothers income...they only factor in his income. In the state of NV you can only go for an increase every 3 yrs...so you may have to wait 3 yrs before you can ask for an increase...ck your state laws_
