You have to do a capital crime such as murder (depends on the circumstances of the murder) or treason.

In this country you must be responsible for a murder in order to get the death penalty. Of greater importance is that you have to be poor and uneducated, you have to be unable to hire a competent lawyer and, finally, it helps if the victim was white.
It also helps if the crime was committed in a state that does not have life without parole on the books. It helps if the state does not care about spending all the extra money a capital punishment system costs, instead of spending it on things like victims services.

Not a lawyer. But most times a capital offense had to be committed; say you hold up a bank, armed of coarse and you had to kill a person. I think that would be a capital offense. Your partner does not have to fire a shot and he will get the same. But the Judicial system 'sucks". Take the O.J. case. I watched it for six months. But think of the prisioners that are own death roll that are innocent. Barry Sheck, is helping people that are in that predictament. The thing that I can't understand is when he finds a party innocent why does it take another two to five years to get them released. Just don't understand.

If your state does not have the death penalty..you won't get it.. you will most likely get life in jail with no possibility of parole..depending on how bad the crime is..Usually on murder gets that sentence..
