Comparing federal and state jurisdictions is like comparing apples to the 18-wheeler that hauls them.

Answer A is a sticky wicket. Education is nearly controlled by the teacher's unions. But you will find it difficult to separate your local teachers from the national union to which they belong.

Answer D is also problematic. There are local and state agencies devoted to justice. Yet there are also federal courts and jurisdictions. They serve different, yet important functions. Your local police may have been partially funded with federal dollars. And on the other hand, the highest Court in the nation effectively passed legislation (usurping power from the legislative branch) that says your local government can take your house and give it to ABC Construction to build a mall because the mall will produce more property tax revenue than your house did.

The phrasing of the question is also misleading. The degree to which a federal department has a counterpart in state government does not necessarily limit or expand its role. What role? The role that department plays in your personal life? The role it plays in the national scene? The role it plays in the media?

The Department of Education because they have no rule making or legislative role. Rather, their role is largely there to provide guidelines for the states. it is also the most recent Department to come into existence.

For the purposes of your homework assignment, A)Department of Education. For the purposes of the Constitution, the Department of State is constitutional. I'm not convince any of the others are.

A The govt. is always passing the responsibility on to the state and the majority of my town taxes are paid for state education programs that are required by the state.

A)'s the answer, most educational control is around the state level. They're the ones setting curricula, buying textbooks, setting aside land for new schools, etc..
