Supreme Court can't over turn a case. They can only decide what the law should interpret (judicial review). But there are 9 justices so a majority of 5 should be needed to make a ruling.

A simple majority is all that's needed. The Chief Justice's doesn't get to do anything special in ties (which can only happen if a judge recuses him/herself as there is an odd number); the only special powers are the ability to pick who writes the opinion when he is in the majority at to appoint the FISA court.
