i was going into the driveway of my apartment buildidng one night, when i heard the scratch, from a wire that was sticking out that i did not see. when i got off the car it was a piece if the properties' fence that was pulled out. now my new car has this long scratch, and the property management is giving me the run around. it just so happens that the building was sold, so theres new management. the old management is telling me to talk to the new people that took over, but they have nothing to do with this. nor they want to. i called consumer affairs. and they are telling me that they are not responsible, so who is? am i stuck with $400 worth of damage, because of their fence. what if a kid was playing/running and poke an eye out?

Great picture. I think it's obvious from the picture that the owner failed to properly maintain that ugly fence and is negligent, and damage caused by his negligence should be covered by his insurance.
The insurance of the owner on the day of the occurrence is the one who is responsible for handling your claim.
As noted by one other responder, your insurance company has a stake in this also although they could potentially hit you for deductible on collision insurance so you still might be fighting this by yourself is the damage is under the deductible.
You might argue that it is comprehensive damage, but the car was moving so I don't know how far you'd get. Rocks hitting windshields are comprehensive so maybe this might be also.
There is no doubt in my mind that you have a legitimate beef here.

I have found that the best place to start is the better business bureau. At the very least, you could lodge a complaint about either one or both management parties. I'm not sure if they would be responsible for something that should have most likely been avoided, but you could definitely make a case if you document it with pictures of your car, the wire and the time. I would take pictures both during the day and at night to indicate how dark it was and how you could not have seen it. You may be able to settle it in small claims court, but if it is $400, it might be too costly to hire a lawyer.

they may be under new management but the property is still owned by the same ppl..management r not the owners of the property they just manage the apartment complex..take pictures of the fence n ur car n find out who owns the property n then file a lawsuit at the courthouse.it doesnt cost but $10 or $20 to file a lawsuit against someone...a lawyer will charge u more than the damage of ur car....

Make sure you take some photos of the fence and the damages and verify if there are new property owners.File a suit in small claims...That's the only way to see some action...
See if there is a legal aid society where you live that can help you... since its a landlord tenant issue.

Well if you hit in the rear u maybe liability, do u think u r liability for her damage if so ask her for three estimate for the damage r just give it to ur insurance and let them deal with it . To late to call the police no injures but you can go to the police station and fill out a report, for the accident and the harassing. She can take you to small claims court. You need to take pictures of her damages and the picture of your car to show the the damages are not that bad. The next question what type of business is she ope-rationing and do this business have the current license and permit to operation and she such have contract with her if not there are employee and she needs to be report to the labor board and check with better business bureau.

As for the kid part, it is a safety reason if it as sharp as you say. but as for you, your car is not there responsibility. it is like backing into a light post in a target parking lot (it isn't Target's fault). If you wanted to get most of the scratch off, you can go get a buffer which costs $80 dollars and some soolution for it which costs around $20. If you buff on and around the scratch, the solution should fill it in with some of the pain around the scratch itself and greatly minimize the appearance of it. It may even take the scratch away.
