alright here's the deal...i might be getting fired from hollister, heres whats up

at hollister, if we need days off, we go to the computer, log onto our account thing, and go to the calender and click on the days we cannot work

so heres what happened
two weeks ago, i took off tuesday, wednesday, and friday of this week. last week, i checked the comptuer and it said that the managers approved of the days i needed off. HOWEVER, they still scheduled me for those 3 days, even though i took the days off and they approved. today i called them and told them i could not come in and that i took these days off two weeks ago and it was approved.

a few mintues ago, my friend called me and told me i was screwed!!

wtf, i clearly let the managers know i could not work, they approved, but they still scheduled me and now i might get fired because i didn't go in.

it would be unfair if i get fired, can i sue???

i tried to fix the problem but they obviously dont listen, TODAY I CALLED THEM UP AND LET THEM KNOW THEY MESSED UP MY SCHEDULE AND TOLD THEM I COULD NOT COME.

they can't fire me because i didn't come into work because i could not make it in, which is why i took that day off. they decided not to listen and schedule me anyway

if you're temporary help for the holiday season, no. if you've been there for a long time (more than the last 6 months) then you might be able to do something about it. you could file a complaint with the company (not your branch, above your branch). tell them what happened and try to work something out. this is only if they fire you though.

if you're a seasonal worker you really don't have a leg to stand on. they hire people like you to fill in the slots for the holiday season. retail gets busy, they need more people. they hire you. you're expendable. you can't really take any days off. especially so many days right before the holiday that you were hired for. chances are, you will prolly get fired if you were seasonal. but prolly not until the end of january. my thoughts are, look for another job (preferably not in retail, because the same thing wil lhappen somewhere else).

update: since you are an established employee for the most part then you should either transfer or file a complaint. if they gave you those days off in the begining, get proof and then send all the info to your district manager. sometimes there are problem stores, there may be other people like you in the district that are getting treated like crap. send all the info you obtain to the district manager or the regional manager. all these people's info should be available to you if you just ask for it. don't let people at work harass you. if you're in the right and they threaten to fire you, do what i said before about the letter to your managers, managers, manager. the higher you go the more power they have. if you have a good record and proved to be a valuble employee you shouldn't have any problems.

You have no case, the 2 week is an accepted time but doesn't have to be The termination was legal and you can not sue them for anything else File for unemployment

No, you can't. If they fired you for a protected reason (age, handicap, etc.) then you'd have grounds. However, not coming in when scheduled is a valid reason for firing.

If it is truly an approved mistake, then you are not going to get fired. Bring proof that your vacation was approved to your boss (and if he's the one who approved it and is firing you, his boss) and you will be fine.

Most states are "at-will" employment and they can terminate you without having any reason and you have no recourse unless you are in a protected group or you can prove that it was a conspiracy due to your race, religion, sex, sexual orientation or age.

However, if you have documented proof that the days off you requested it could make a difference in whether or not you can collect unemployment.

What you should have done is fixed the problem. Simply because you do not feel it is a problem does not exclude you from dealing with the problem.

BTW, you are an employee. You work for the company. If they want to fire you, it is their company.

i would request a transfer if you wanted to, if there's one closer to your home. because it seems like the management there is not the best in the world. i wouldn't sue over something like that. i'd just try to see if you can transfer to another store, talk to the manager about it, talk to your friend to see if he's making the whole thing up, or just find another job. best of luck!

no you cannot sue, you dont have an employment contract...you are an at will employee, they can fire you at any time for any reason (exceptions: discrimination)
