If you are in the US, it depends on what state you are in.
Texas, for example, is a community property state. Based on your scenario, the title company would write the check with both of your names on it. If you both agreed to split the proceeds, you can give the title company authorization to do so.
In this situation, title companies don't care what the divorce decree says.
