Depends on how long you've been married and if there are any children.
If there are no children, you dont have to wait. Any marriage that hasnt "seasoned" meaning that you've been married less then 12 months, you can get annulled.Over 12 months, then you need to file for divorce.
If there are children involved, then you have a whole new ballgame ahead of you.

you do not have to wait go to the court house and file then which ever state you live in has a waiting period for 3 to 6 months before judge will sign unless you can get it annulled then quicker but need lawyer.
