It's just Trespassing. This is not the tort of Invasion of Privacy. He has no expectation of privacy when the people enter his yard to look at something they can see from the sidewalk outside his property.
If they were peeking into his windows then that might be Invasion of Privacy.
I'd like to address the issue that Phoenix brought up about whether this guy is liable if the trespassers get hurt on his property. I believe he is liable for a trespassers injury only when he (property owner) knows the defect on his property is dangerous (like a huge pit). On the other hand, if an invited guest is on his property then he is liable for defects that he knew or should have knoen about.

invasion of privacy is against the law no matter what kind of fence you have around your property however the courts my not see it as an invasion of your privacy merely because someone peeks into your back yard. An example of invasion of privacy would be if someone was to look into your personal files. Its no different than say if your neighbor's kid had a tree house on his property that had a clear view into your backyard. While it would be rude to look into your backyard its far from being illegal and therefor not an invasion of your privacy.

It is called trespassing for one. If they have to climb over the fence to get access to your yard. And It is a invasion of privacy to take photos of whats in the yard. The only people allowed to do that is the police.

Guess that depends. Can a person easily look into your car while you drive and would that be and invasion also?
I would think that if the fence was on your property and if you have posted it you may have something to discuss. Yet on the other hand what's that important in your back yard that you don't want others to see. Illegal? Topless Babes? Little Wacky Weed?
Not being smart it just cost money to go to court and time and hassle and is it worth it...

harassment but you must have very good documentation (I would set up a video camera). If they don't come on to your property there is not much you can do unless you have good documentation. Your neighbor can sit up in a tree and watch what is going on in your back yard and it is legal.
